Jail Time for DUI

Orange County DUI Jail Penalties

If you are arrested for driving under the influence in Orange County, will you go to jail? Jail time is up to the judge's discretion and will be proportionate to your offense, if convicted.   • 3 years in prison for DUI that causes injury with the addition of one more year for every other person injured.
  • 4 years in prison and a maximum 10 years in prison for DUI that causes the death of another.

Jail Time Enhancements for DUI

There are other factors that could increase your jail sentence if convicted. These factors include:

  • DUI at or above twice the legal limit
  • DUI with child passenger ("child" defined as a person under 14 years of age)
  • DUI with reckless driving
  • DUI while license is suspended or you are on formal probation for another offense
