DUI Probation in Orange County
§ 23600 California Vehicle Code
One of the
penalties you can face after a
DUI arrest is probation. In California, there are minimum probation conditions
for drunk driving charges which are outlined in § 23600 of the California
Vehicle Code. Many people think of probation as more of a penalty than
a benefit, when in fact it's really the opposite. Probation can be
granted in lieu of jail time, and can entail alcohol rehabilitation, community
service, and fines, among other things.
How long does DUI probation last?
According to the vehicle code, probation for DUI (when granted) lasts at
minimum three years, and a max of five years. In some cases, when the
sentence for the alleged offense is more than five years in prison, then
the length of probation can be adjusted.
What are the other conditions of probation?
The judge may impose any one or more of the following as a condition of
DUI probation:
- The accused cannot drive with any amount of alcohol in his or her bloodstream
- The accused cannot commit any criminal offense
- The accused must submit periodic chemical tests (breath, blood, or urine)
- Fines or restitution (if victims were involved)
Violating DUI Probation: VC § 23602
Anyone who violates any term of the DUI probation could have his or her
probation revoked. If your probation is revoked, you will likely receive
a jail sentence. In some cases, the judge will choose to issue a warning
first or they may extend or tighten the terms of your probation. The worst-case
scenario would be probation revocation. If you were sentenced to probation
as part of a deferred entry of judgment (DEJ) then you may no longer qualify
for charge dismissal.
